- By submitting the Order, the Customer makes a binding offer to conclude a purchase contract with the Seller.
- After the Order has been submitted, the Seller sends an automatic confirmation of receipt of the Order to the e-mail address provided by the Customer. This automatic confirmation does not in itself constitute acceptance of the Order and does not constitute conclusion of the Contract, unless the confirmation expressly states otherwise.
- The purchase Contract is concluded when the Seller expressly confirms acceptance of the Order or dispatches the Goods to the Customer.
- The Seller reserves the right not to accept an Order, in particular if:
• the Goods are not available,• there is an obvious error in the price, product description, availability or other essential information,• payment has not been made properly or on time,• the Customer has provided incorrect or incomplete data,• the Order appears to be fraudulent, unlawful or contrary to these Terms and Conditions,• legal restrictions apply to the Goods or to their delivery to the Customer’s country,• the Order concerns an unusually large quantity of Goods and, based on the circumstances, it may reasonably be assumed that it is not a normal consumer purchase or that it is intended to exploit an obvious error.
- The Seller reserves the right not to accept an Order or to cancel an already confirmed Order if the price, description, availability or other essential information concerning the Goods was displayed incorrectly in the Online Store due to an obvious technical, administrative, system, data transmission or pricing error.
- An obvious pricing error may exist in particular where the displayed price of the Goods is conspicuously disproportionately low compared with the usual market price, purchase price or the price generally applied by the Seller, and it is reasonably recognisable to the average Customer that an error has occurred.
- In such a case, the Seller shall inform the Customer without undue delay, may cancel the Order, and if the Customer has already paid, shall refund the amount paid using the same payment method, unless the Customer agrees to another refund method.
- The Seller also reserves the right not to accept or to cancel unusually large or repeated Orders aimed at exploiting an obvious pricing error.

§ 6 Price and payment
- The prices displayed in the Online Store include VAT, unless expressly stated otherwise.
- In the English version of the Online Store, prices may be displayed in the currency available in the relevant store version or checkout. If more than one currency is displayed, the final price and currency shown during the checkout process shall apply.

- For deliveries outside the European Union, the Customer may be required to pay customs duties, taxes or other import costs. These costs are not included in the price, unless expressly stated otherwise.
- The Seller reserves the right to change prices. Price changes do not affect Orders already accepted by the Seller, except in the case of an obvious pricing error regulated in these Terms and Conditions.
- If the Online Store displays a reduced price, the Seller provides information about the previous price where required by applicable law.
- Goods offered as part of promotions, discounts or sales may be limited in time or quantity.
- Available payment methods are displayed in the Online Store during the ordering process and may vary depending on the delivery country, currency, order value or technical availability of the relevant payment method.
- The Customer may pay for the Order using one of the payment methods offered in the checkout, in particular online card payment, PayPal, bank transfer or another payment method made available by the Seller.
- Online card payments may be processed through the Barion payment system. The payment service provider is Barion Payment Zrt., an electronic money issuer supervised by the National Bank of Hungary, licence number H-EN-I-1064/2013. Card payment is made through the secure Barion interface. The Seller does not receive or process the Customer’s payment card data; the Seller is only informed about the result of the transaction. Registration with Barion is not required for card payment.
- If PayPal is selected as the payment method, the payment is processed by PayPal according to PayPal’s own terms and conditions. The Customer may be redirected to the PayPal interface to complete the payment.
- If bank transfer is selected as the payment method, the Customer shall pay the Order price using the payment instructions provided by the Seller after the Order is placed. The Order may be processed or dispatched after the payment has been credited to the Seller’s bank account, unless the Seller decides otherwise.

- Delivery times are indicative, unless expressly guaranteed. Delivery time may be affected by the Carrier, customs procedures, public holidays, force majeure or other circumstances beyond the Seller’s control.
- The Goods are delivered to the delivery address or selected pick-up point provided by the Customer during the ordering process.
- The Customer is obliged to provide complete and correct delivery details.
- When the Goods are dispatched, the Seller may send dispatch confirmation and tracking information to the Customer by e-mail.
- The Customer is obliged to inspect the package upon receipt. If the package is visibly damaged, the Customer should notify the Carrier and, if possible, request a damage report.
- If the Goods arrive damaged or incomplete, the Customer should contact the Seller without undue delay, in particular through the Claims Centre.
- The invoice or tax document is issued in accordance with applicable tax laws.
- The Customer acknowledges that the delivery of Goods may also be performed on behalf of the Seller by logistics or fulfilment partners. This does not affect the Seller’s responsibility towards the Customer for performance of the Contract.
§ 8 Consumer’s withdrawal from the Contract
- The Consumer has the right to withdraw from a distance contract without giving any reason within 14 days.
- The withdrawal period starts:
• on the day on which the Consumer or a third party designated by the Consumer, other than the Carrier, takes possession of the Goods,• in the case of several Goods delivered separately, on the day on which the last Goods are taken over,• in the case of regular delivery of Goods over a defined period, on the day on which the first delivery is taken over.
- To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw from the Contract by means of a clear statement, which may be sent to the Seller’s contact address, e-mail address or through the Claims Centre.
- The Claims Centre is available at: https://hop-up.eu/en/complaint-centre.
- The Consumer may use the form available in the Claims Centre, but its use is not mandatory.
- To meet the withdrawal deadline, it is sufficient for the Consumer to send the withdrawal statement before the 14-day period expires.
- After the notification has been sent, the Seller informs the Consumer by e-mail about the method of returning the Goods and the return address. The return address may differ from the Seller’s registered office.
- The Consumer is obliged to return the Goods in accordance with the instructions provided by the Seller. The Consumer is not obliged to wait for the Seller’s response if this would prevent the exercise of the right of withdrawal; however, following the Seller’s return instructions helps ensure fast and proper processing of the return.
- In the event of withdrawal, the Contract is terminated and the Seller refunds the payments received from the Consumer, including the cost of the cheapest standard delivery method offered by the Seller for the original delivery.
- The Seller may withhold the refund until the Goods have been received back or until the Consumer has provided proof of having sent the Goods back, whichever occurs earlier.
- The Consumer is obliged to return the Goods without undue delay, but no later than 14 days from the day on which the Consumer informed the Seller of withdrawal from the Contract.
- Unless the Seller informs the Consumer otherwise, the Consumer bears the direct cost of returning the Goods.
- The Consumer is responsible for any decrease in the value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
- The Seller refunds payments using the same payment method used by the Consumer, unless the Consumer agrees to another method and this does not incur additional costs for the Consumer.
- Refunds are processed without undue delay in accordance with applicable law. In the case of card payments, the refund is usually made back to the same payment card or payment method used for the original transaction, unless another refund method is agreed with the Consumer.
- The right of withdrawal does not apply in the cases specified by applicable law, in particular:
• to Goods made according to the Consumer’s instructions or clearly personalised Goods,• to Goods that deteriorate quickly or have a short shelf life,• to sealed Goods which are not suitable for return for health protection or hygiene reasons after unsealing,• to Goods which, after delivery, are inseparably mixed with other items due to their nature,• to Digital Content supplied on a non-tangible medium, where performance has begun with the Consumer’s prior express consent and acknowledgement of the loss of the right of withdrawal, where applicable.
- This section applies accordingly to entrepreneurs with consumer rights where applicable under the governing law.
§ 9 Rights arising from defective performance and non-conformity of the Goods with the Contract
- The Seller is responsible towards the Consumer that the Goods are free from defects and conform to the Contract upon receipt.
- The Goods conform to the Contract if, in particular, they correspond to the agreed description, type, quantity, quality, functionality, compatibility, safety and other agreed characteristics.
- The Goods must also be suitable for the purpose for which goods of the same type are normally used and have the characteristics that the Customer may reasonably expect with regard to the nature of the Goods and public statements made by the Seller or the manufacturer.
- If the Goods are defective or do not conform to the Contract, the Consumer may exercise rights under the applicable law.
- Depending on the nature of the defect and the applicable law, the Consumer may in particular request repair, replacement, an appropriate price reduction or withdrawal from the Contract.
- The Customer may submit a claim to the Seller in particular:
• through the Claims Centre: https://hop-up.eu/en/complaint-centre,• by e-mail: claims@hop-up.eu,• in writing by letter sent to the Seller’s registered office.
- When submitting a claim, the Customer should, where possible, provide:
• the order number or proof of purchase,• identification of the Goods,• description of the defect,• preferred method of claim resolution,• contact details,• in the case of damaged shipment, where possible, photographs of the packaging and the Goods.
- After the claim has been submitted, the Seller informs the Customer by e-mail about the further claim procedure, in particular whether it is necessary to return the Goods, and provides the return address and instructions for returning the Goods.
- The return address may differ from the Seller’s registered office. The Customer is obliged to return the Goods in accordance with the instructions provided by the Seller.
- The Customer may not return the Goods without proper packaging. The Goods must be packed so that they are not damaged during transport.
- The Seller handles claims without undue delay and informs the Customer of the result.
- Consumer claims are handled within the period provided by applicable law, generally no later than within 30 days, unless a longer period is agreed with the Consumer or mandatory law provides otherwise.
- If the claim is justified, the Seller bears the necessary costs associated with the claim in accordance with applicable law.
- Any manufacturer’s warranties provided for individual Goods, if any, do not limit the Customer’s statutory rights arising from defective performance.
§ 10 Complaints relating to Electronic Services
- The Customer may submit a complaint to the Seller regarding the functioning of the Online Store or Electronic Services by e-mail, in writing or through the Claims Centre.
- The complaint should include a description of the problem and the Customer’s contact details.
- The Seller handles the complaint without undue delay and informs the Customer of the result.
§ 11 Provisions applicable to non-Consumer Customers
- In the case of Customers who are not Consumers or entrepreneurs with consumer rights, the Seller’s liability for defects may be limited or excluded to the extent permitted by applicable law.
- In the case of Customers who are not Consumers or entrepreneurs with consumer rights, the Seller is not liable for indirect damage, lost profit or other consequential damage, unless caused intentionally or unless such limitation is prohibited by law.
- In the case of a non-Consumer Customer, the risk of damage to the Goods passes when the Goods are handed over to the Carrier, unless mandatory law provides otherwise.
- The Seller may withdraw from a Contract concluded with a non-Consumer Customer if the Order cannot be fulfilled for objective reasons, including unavailability of the Goods, pricing error, legal restrictions or other serious reasons.
- Disputes with non-Consumer Customers shall be resolved by the competent Czech courts, unless mandatory law provides otherwise.
§ 12 Product reviews
- If the Online Store enables Customers to add reviews, the Seller may verify whether a review is related to a genuine purchase.
- Reviews may be marked as verified if the Seller can reasonably confirm that the reviewed Goods were purchased by the Customer.
- The Seller may refuse or remove reviews that:
• are untrue, misleading or unrelated to the Goods,• contain vulgar, offensive, discriminatory or unlawful content,• contain spam, advertising or links unrelated to the Goods,• infringe third-party rights,• contain personal data or confidential information.
- The Seller does not modify the substance of reviews in a way that would distort their meaning. The Seller may remove prohibited content or correct obvious technical errors.
§ 13 Personal data and cookies
- The Seller processes personal data in accordance with applicable data protection laws.
- Information on the processing of personal data is provided in the Privacy Policy available in the Online Store.
- The Online Store uses cookies and similar technologies. Details are provided in the Cookie Policy or cookie settings available in the Online Store.
